Alberta Innovates - Terms of Use

These Terms of Use (“Terms”) were last updated on April 18, 2024.

The following terms and conditions (“Terms”) govern your account and participation in online and instructor-led courses, workshops, webinars, and community engagement offered by Alberta Innovates (referred to as 'we,' 'us,' or 'our') using Thinkific (referred to as 'the Platform').  By signing up for our courses, you agree to comply with these Terms. Please read these Terms carefully before proceeding as they serve as an enforceable contract between you and us and contain important information about your legal rights, remedies and obligations. Alberta Innovates reserves the right to change or modify any of the Terms contained in the Terms of Use at any time by posting updates and changes on our site in Thinkific.

 

1. Account Term:

You must be at least the age of majority in the jurisdiction where you reside or from which you use the Services.  

In signing up and creating your user account, you agree to:

  1. provide accurate and complete information required to set up your account.
  2. maintain and promptly update the information you provide during account setup to keep it accurate, current and complete.
  3. maintain the security of your password and account.  You are responsible for all activity within your account, and it is solely your responsibility to keep your user account and password secure.  We will not be liable for any losses or damages caused by any unauthorized use of your account. You must notify us immediately of any breach of security or unauthorized use of your user account. Should we become aware of any unauthorized activity on your account, we may remove your access.
  4. We will use the email address you provide as primary method of communication.  This includes course enrollment, progress, completion, review, support, upcoming courses, and events.  You may opt-out of such communications on an individual basis by managing your communication preferences within Thinkific.


2. Data Collection and Purpose:

We are collecting your personal information, during the sign-up process through the Platform, under the authority of section 33(c) of the Freedom of Information and Protection of Privacy Act (“FOIP”) to facilitate your participation in our courses. This may include, but is not limited to, your name, contact information, time zone, and demographic details. The purpose of this data collection is to provide an efficient learning experience.  The data we collect will only be used for the purpose stated above or for a related purpose, will only be used as long as it is needed at which time it will be deleted or destroyed, and will not be disclosed to a third party without your prior consent.

3. Consent to Data Collection:

By signing up for our courses through the Platform, you expressly consent to the collection, processing, and storage of your personal information as outlined in these Terms.  You also acknowledge that providing accurate and complete information is essential for the successful administration of the courses.

4. Use of Personal Information:

We will use your personal information for the following purposes:

  1. Course administration, communication, and support.
  2. Tailoring course content to meet your needs.
  3. Analyzing and improving our courses and services.
  4. Compliance with legal and regulatory obligations.
  5. Participating in course assignments.
  6. Participating in course discussions.


5. Platform's Terms and Privacy Policy:

In addition to these Terms, your use of the Platform is governed by its own terms of service and privacy policy. We recommend that you review the Platform's terms and private policy here to understand how your data will be handled on their end.

6. Data Security:

While we implement reasonable security measures to protect your personal information, it's important to note that the Platform may have its own security measures. We encourage you to review the Platform's Security Overview and Controls Policy here ensuring a comprehensive understanding.  We cannot guarantee the security of any information uploaded to the Platform due to the nature of the internet and make no representations or warranties that the Platform will work properly or at all.

7. Data Sharing:

The Platform may be accessed by third parties such as facilitators and instructors and their host institutions who are engaged or contracted for course and workshop facilitation, administration, communication, and support. These third parties are required to adhere to privacy and security standards consistent with this document.  By using the Platform, you consent to us sharing any information you upload with such third parties so we can provide a better course offering on topics of relevance to you.  

8. Retention of Data:

We will retain your personal information for the duration of your participation in our courses and for a reasonable period afterward, as necessary for record-keeping and legal compliance.

9. Access and Correction:

You have the right to access and correct your personal information held by us. You can do so by signing into the Platform and navigating to the User Profile section.

10. Intellectual Property:

All course materials, including but not limited to videos, presentations, documents, and any other content provided, are the intellectual property and exclusive copyright of Alberta Innovates. You may not reproduce, distribute, or publicly display any course materials without our prior written consent.

11. Code of Conduct:

You agree to adhere to a code of conduct that promotes a respectful and inclusive learning environment. Any disruptive or inappropriate behavior may result in immediate termination of your access to the course without refund.

12. Fees and Payments:

If applicable, you agree to pay all fees associated with the course within thirty (30) days of being registered. Failure to do so may result in the suspension of your access to the course.

13. Refund Policy:

Refund policies may vary by course. Please refer to the specific course details or contact us at [email protected] for information on refunds.

By signing up for our courses through the Platform, you acknowledge that you have read, understood, and agreed to these Terms.  If you do not agree with any part of these Terms, please refrain from signing up or enrolling to any Alberta Innovates’ courses through the Thinkific platform.

14. Exclusions and Limitations of Liability:

Owing to the nature of the internet there is no guarantee that this Platform will work properly or at all or always be available to users. You should ensure that you have appropriate protection against viruses and other security arrangements in place whilst using the internet. The Platform and any information or other material contained in it are made available strictly on the basis that you accept it on an "as is" and "as available" basis.  Where you rely on any information or other material contained in it, you do so entirely at your own risk and you accept that all warranties, conditions, and undertakings, express or implied, whether by common law, statute, trade usage, course of dealings or otherwise in respect of this Platform are excluded by AIberta Innovates to the fullest extent permitted by law.  Further, to the extent permitted by law, Alberta Innovates will not be liable for any indirect, incidental, punitive, or consequential damages (including loss of data, revenue, profits or business opportunities, or personal injury or death), whether arising in contract, warranty, tort, product liability or otherwise. Our liability to you or any third party under any circumstance is limited to the amount you have paid us for use and access of the Platform. WITHOUT LIMITATION TO THE FOREGOING, NO WARRANTY IS GIVEN THAT THE PLATFORM WILL BE FREE FROM VIRUSES, TROJAN HORSES, BUGS, OMISSIONS OR ERRORS, OR THAT DEFICIENCIES OR DEFECTS IN THE PRODUCT OR WEBSITE WILL BE CORRECTED.
